These Terms of Use ("Terms") govern your access to and use of Coin Identifier (the "Service"), operated by Obzena LLC, a Wyoming limited liability company ("Company," "we," "us"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or 16 in the EEA) to use the Service. By using it, you represent that you meet this requirement.
2. Service Description
Coin Identifier provides AI-assisted identification, dating, and approximate valuation of coins from images you upload. Identifications are generated by an artificial-intelligence model and are provided on an "as-is" basis. They are not a substitute for professional appraisal, certified grading, or legal authentication.
3. AI Disclaimer
You understand and acknowledge that:
- Images you submit are processed by third-party AI providers, including OpenAI, L.L.C., as detailed in our Privacy Policy.
- AI-generated content can be inaccurate, incomplete, or out-of-date. Valuations are estimates only.
- You should never rely solely on the Service for purchase, sale, insurance, or legal decisions involving coins of significant value.
4. User Content & License
You retain ownership of any images and content you submit ("User Content"). By submitting User Content, you grant Obzena LLC a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit it solely for the purpose of operating, securing, and improving the Service. You represent that you own the rights to any image you submit, or have permission from the owner.
5. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or scrape the Service.
- Submit unlawful, harmful, infringing, sexually explicit, or non-coin imagery.
- Attempt to bypass authentication, rate limits, or paid features.
- Use the Service to compete commercially against Obzena LLC.
6. Subscriptions & Payments
Premium features may require a paid subscription. All payments are processed by Apple App Store or Google Play. Subscription terms (price, duration, renewal) are disclosed at the point of purchase. Cancellations and refunds are governed by the rules of the respective platform.
7. Intellectual Property
The Service, including its software, design, text, graphics, and trademarks, is owned by Obzena LLC and protected by U.S. and international copyright, trademark, and other laws. You may not copy or republish without prior written permission.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT IDENTIFICATIONS WILL BE CORRECT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBZENA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) USD $50 OR (B) AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Obzena LLC and its officers, directors, employees, and agents from any claims, losses, or damages arising from your User Content or breach of these Terms.
11. Termination
We may suspend or terminate your access at any time, without notice, for any breach of these Terms or for any reason. You may stop using the Service at any time.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.
13. Changes to Terms
We may update these Terms occasionally. The "Last updated" date at the top reflects the most recent revision. Continued use after changes constitutes acceptance.
